In 2016, we brought you news of an admission of liability from the Health Service Executive in relation to medical negligence proceedings, arising from the birth of a child at South Tipperary General Hospital, Clonmel in 2001. The baby was subsequently diagnosed with cerebral palsy.
We are glad to be able to announce that the case was subsequently settled on an interim basis for the period of 2 years for a sum of €2,000,000.00, to include such items as housing, care (past and future), physiotherapy, aids and appliances and assistive technology.
It also includes a once off payment in respect of general damages and his future loss of earnings, as it is unlikely that he will ever be able to secure employment in the open market. After the period of two years has elapsed, his needs will be re-assessed and the case will come before the Court again.
